Overview

This website, timberhouse.net, is operated by Brighton Shores Summer Estates Ltd., an Ontario corporation operating as Timber House Resort. Throughout the site, "we", "us" and "our" refer to Brighton Shores Summer Estates Ltd. We offer this website, including all information, tools and services available from it, to you, the user, on condition that you accept all of the terms, conditions, policies and notices stated here.

By visiting our site, making a purchase, booking accommodation, or buying an event ticket, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including the additional policies referenced here or available by hyperlink: our Privacy Policy and our Refund Policy. These Terms apply to all users of the site, including browsers, customers, guests, and contributors of content.

Please read these Terms carefully before using our website. If you do not agree to all of them, you may not use the site or the Service.

Any new features or tools added to the site are also subject to these Terms. We may update, change or replace any part of these Terms by posting updates to this page. It is your responsibility to check this page periodically. Your continued use of the site after changes are posted constitutes acceptance of those changes.

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell products, accommodation and event tickets to you.

These Terms cover this website only. Your stay at the resort, your seasonal site, or your residential unit is governed by the applicable booking confirmation, Seasonal Licence of Occupation, tenancy agreement, event contract, and the Timber House Resort Property Rules. Our private online property portal at app.modelpie.ca is governed by its own Terms of Use, published at app.modelpie.ca/terms.

Section 1 — Online store terms

By agreeing to these Terms, you represent that you are at least 18 years of age, or that you are the age of majority in your province or territory of residence and have given us your consent to allow any minor dependents to use this site.

You may not use our products or services for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including copyright laws). You must not transmit any worms, viruses or any code of a destructive nature. A breach of any of these Terms will result in immediate termination of your access to the Service.

Section 2 — General conditions

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including payment card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.

The headings in this agreement are for convenience only and do not limit or affect these Terms.

Section 3 — Accuracy, completeness and timeliness of information

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources. Any reliance on the material on this site is at your own risk.

This site may contain historical information, which is provided for reference only. We reserve the right to modify the contents of this site at any time, but have no obligation to update any information. You agree that it is your responsibility to monitor changes to our site.

Section 4 — Modifications to the Service and prices

Prices for our products, accommodation and tickets are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part of it) without notice. We are not liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.

Section 5 — Products, accommodation, events and tickets

Certain products or services may be available exclusively online through the website and may be available in limited quantities. Returns, cancellations and refunds are governed by our Refund Policy.

Accommodation bookings. Reservations for hotel rooms, cottages and short-term accommodation are made through InnRoad, our booking system, which you reach through the booking links on this site. InnRoad's own terms apply to the booking engine and to any payment you make there. A booking is a request until confirmed by us. Check-in and check-out times, occupancy limits, cancellation terms and house rules are set out in your booking confirmation and the Property Rules. Guests are responsible for the conduct of everyone in their party and for any damage caused during their stay.

Guest text messaging. We communicate with short-term accommodation guests by text message through Akia, a guest-messaging service, for arrival instructions, check-in details and questions during your stay. By providing a mobile number with your reservation you agree to receive these messages. Carrier rates may apply; reply STOP to opt out. See our Privacy Policy for what Akia receives.

Weddings, reunions, festivals and group events. Event hosting is subject to a separate written event agreement that governs deposits, dates, capacity, vendors, insurance and cancellation. Nothing on this website constitutes an offer to host an event until that agreement is signed.

Event tickets. Tickets purchased on this site are for admission to the named event on the stated date. Each ticket carries a unique code and QR code and is valid for one admission. Ticket orders placed here are automatically transmitted to our property portal at app.modelpie.ca, which issues the ticket and emails it to the address you provide. Tickets are non-transferable unless we say otherwise for a particular event, and may be refused or cancelled if they were obtained fraudulently, resold in breach of these Terms, or if the holder breaches the Property Rules. Event dates and line-ups may change; our Refund Policy applies. We may also sell tickets for the same events through other channels; ticket terms are the same regardless of channel.

We have made every effort to display accurately the colours and images of our products and property. We cannot guarantee that your monitor's display of any colour will be accurate. We reserve the right to limit sales of our products or services to any person, geographic region or jurisdiction, and to limit quantities. All descriptions and prices are subject to change at any time without notice. Any offer made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Section 6 — Accuracy of billing and account information

We reserve the right to refuse any order or booking. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order, including orders placed under the same customer account, the same payment card, or the same billing address. If we change or cancel an order or booking, we will attempt to notify you using the email address or phone number provided at the time of the order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by resellers.

You agree to provide current, complete and accurate purchase, booking and account information, and to promptly update your account information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Section 7 — Optional tools and connected services

We may provide you with access to third-party tools over which we neither monitor nor have any control or input, including the InnRoad booking engine, the Akia guest-messaging service, payment providers and the app.modelpie.ca portal. You acknowledge that we provide access to such tools "as is" and "as available" without warranties, representations or conditions of any kind and without endorsement. Any use of optional tools is at your own risk, and you should ensure that you are familiar with and approve of the terms on which those tools are provided by the relevant third party. Any new services or features we offer through the website in future are also subject to these Terms.

Section 8 — Third-party links

Certain content, products and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy and have no liability for third-party materials, websites, products or services. Please review the third party's policies carefully before you transact with them. Complaints about third-party products should be directed to the third party.

Section 9 — User comments, feedback and other submissions

If, at our request, you send specific submissions (for example contest entries) or, without a request from us, you send creative ideas, suggestions, proposals, plans or other materials, whether online, by email, by post or otherwise (collectively "comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use those comments in any medium. We are under no obligation to keep comments in confidence, to pay compensation for them, or to respond to them.

We may, but are not obligated to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that violates any party's intellectual property or these Terms.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other proprietary rights, and will not contain defamatory, unlawful, abusive or obscene material or any malware. You may not use a false email address, pretend to be someone else, or otherwise mislead us or third parties about the origin of any comments. You are solely responsible for your comments and their accuracy.

Section 10 — Personal information

Your submission of personal information through this site is governed by our Privacy Policy, available at timberhouse.net/policies/privacy-policy. That policy is the privacy policy of Brighton Shores Summer Estates Ltd. and also applies at the resort and, together with a supplementary policy, to the app.modelpie.ca portal.

Section 11 — Errors, inaccuracies and omissions

Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, offers, availability or event details. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders or bookings if any information is inaccurate, at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information on the site except as required by law. No specified update or refresh date should be taken to indicate that all information has been modified or updated.

Section 12 — Prohibited uses

In addition to other prohibitions in these Terms, you may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any federal, provincial, municipal or international law or regulation; (d) to infringe our intellectual property rights or those of others; (e) to harass, abuse, insult, harm, defame, intimidate or discriminate against anyone on any ground protected by the Ontario Human Rights Code; (f) to submit false or misleading information; (g) to upload or transmit viruses or other malicious code; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website. We reserve the right to terminate your use of the Service for violating any of these prohibitions.

Section 13 — Disclaimer of warranties; limitation of liability

We do not guarantee, represent or warrant that your use of the Service will be uninterrupted, timely, secure or error-free, or that the results obtained from the Service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods or cancel it at any time without notice.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered through it are (except as expressly stated by us) provided "as is" and "as available" without any representation, warranties or conditions of any kind, express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

To the maximum extent permitted by applicable law, in no case shall Brighton Shores Summer Estates Ltd., its directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Service or any products or services obtained through it, or from any errors or omissions in any content, even if advised of the possibility. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in those jurisdictions our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under Ontario law, including under the Consumer Protection Act, 2002.

This section applies to your use of this website. Liability arising from your stay at the resort, your seasonal site or residential unit, or an event you host is governed by the applicable booking, licence, tenancy or event agreement.

Section 14 — Indemnification

You agree to indemnify, defend and hold harmless Brighton Shores Summer Estates Ltd. and its affiliates, officers, directors, agents, contractors, licensors, service providers, suppliers, interns and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Section 15 — Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

Section 16 — Termination

The obligations and liabilities of the parties incurred before the termination date survive termination for all purposes. These Terms are effective unless and until terminated by you or us. You may terminate them at any time by notifying us that you no longer wish to use the Service, or by ceasing to use the site. If in our sole judgment you fail, or we suspect you have failed, to comply with any provision of these Terms, we may terminate this agreement at any time without notice, and you remain liable for all amounts due up to and including the date of termination. We may also deny you access to the Service or any part of it.

Section 17 — Entire agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and us regarding your use of this website, superseding any prior agreements, communications and proposals relating to the website. They do not supersede any booking confirmation, licence of occupation, tenancy agreement, event agreement or the Property Rules, each of which governs its own subject matter. Any ambiguities in these Terms shall not be construed against the drafting party.

Section 18 — Governing law

These Terms and any separate agreements by which we provide you the Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree to the non-exclusive jurisdiction of the courts of Ontario.

You can review the most current version of these Terms at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. Your continued use of or access to our website following the posting of changes constitutes acceptance of those changes.
